Privacy Policy for Use of Textual.com and the SMS Share Tool

This Privacy Notice (the “Notice”) was developed by Textual.com (“we,” “us” or “our”) to properly manage the Privacy concerns of individuals that use Textual.com and our distributed “SMS Share Tool”.

Our SMS marketing services comply with CTIA and TCPA regulations and guidelines.  You must explicitly opt in to receive SMS marketing messages from our Advertisers, and we will only share your cell phone with aforementioned Advertisers.

If you opt in to receive SMS marketing messages from any of our Advertisers, you can opt out at any time. The opt out process must be maintained by the Advertisers. This process is regulated by CTIA and TCPA. All Advertisers must provide multiple opportunities to opt out of their SMS marketing.

SERVICE PRIVACY NOTICE

We prepared this Privacy Notice to explain how, why, and when we collect data from you to provide SMS Subscriber services to our Advertisers.

1. About Textual’s Services

Textual provides SMS Subscriber services for our advertiser clients (“Advertisers”). When you visit a website operated by a Publisher or a third party site where we provide the SMS Share Tool, we may collect some or all of the data described in the Textual Service Privacy Notice. Our platform uses that data as well as other data described below to help Advertisers provide SMS Marketing messages that are more relevant to you.

For example, if you use the SMS Share Tool to send the page/product/content via SMS message, our Platform may share your cell phone number with the “Advertiser” that you opted in to.

2. What data we collect and how we use it

We may collect the following categories of information for the purposes explained below.

  • Cellular Phone Number: When you share a page via our SMS Share Tool, we collect your cell phone number.  If you do NOT opt in to the SMS marketing offer from our Advertiser, then this information is NOT shared.
  • Device and browser information: This is technical information about the device or browser you use to access the Publisher’s website. For example, your device’s IP address, cookie string data.
  • We use this data to help our Advertisers identify and deliver SMS marketing messages that are more relevant to you. We also use this data to operate, improve and enhance our services including enhancing the data points we or our Advertising Partners have about a particular user, browser, or device.
3. Data Sharing

Besides sharing your cell phone number with Advertisers you have opted in to, we may also disclose the following ANONYMIZED data.  There is no personal information that we share about you.

  • With an Publisher whose site you have visited: We may share anonymized information about your web behavior.  
  • With our service providers: We contract with companies who help with parts of our business operations. We require that our service providers only use your information in connection with the services they perform for us.
  • In connection with a sale of our business: If a third party acquires some or all of our business or assets, we may disclose your anonymized information in connection with the sale.

We also share technical data that we collect about your browsing habits and your device (such as data relating to our cookies, tracking pixels and similar technologies) with other advertising companies in the digital advertising ecosystem. This enables them and us to better target ads to your anonymized profile.

Finally, we may disclose aggregated, anonymized information with other third parties.

4. Cookies and related technologies

The Textual platform may use cookies, tracking pixels and related technologies to provide our services for Advertisers and Publishers. Cookies are small data files that are served by our platform and stored on your device. They enable us to identify your device when you move between different websites and applications, so that we can provide account information to you.

Specifically, the Textual cookie we serve through the Textual platform for this purpose is named “__Textual”. We may also drop an additional Textual opt-out cookie if you opt-out as described below. We may also drop cookies from our Advertising Partners for the purposes described above. The Advertising Partner cookies dropped vary by Advertiser implementation.

5. Opting out of SMS Marketing messages

We recognize how important your online privacy is to you, so we offer the following information to educate you about your options for controlling the SMS marketing messages you receive.

  • You can opt out of receiving any SMS marketing at any time by simply replying STOP to any SMS message you receive.  This is regulated by CTIA.  See page 10 of this regulatory document. http://bit.ly/2tWL5yk
  • Please note that when using the ad industry opt-out tools described above:
    • If you opt-out we may still collect some ANONYMIZED data about your online activity for operational purposes (such as fraud prevention) but it won’t be used by us for the purpose of targeting SMS messages to you.
6. Data retention

We retain the identifiable data, which is the cell phone number, we collect directly for auditing purposes for 24 months, after which time we delete your number.  Identifiable data collected for other purposes is held no longer than necessary for our business purposes or to meet legal requirements.

7. Security

We apply technical, administrative and organizational security measures to protect the data we collect against accidental or unlawful destruction and loss, alteration, unauthorized disclosure or access, in particular where the processing involves the transmission of data over a network, and against other unlawful forms of processing.

8. Visitors to our Website

We may collect your email address, name, phone number and address on our website.  We keep this information private and do not share it with outsiders for any reason at any time.  The information collected on our website is for our internal operations.  We may send you email from time to time related to your account and account usage.  We may also send you reports about your account.

9. Changes to this Privacy Notice

Changes to this Privacy Notice will be posted on this page. If we make a material change to our privacy practices, we will provide notice on the site or by other means as appropriate.
